BCN Montjuic Tourist Point
The validity period of these terms and conditions is until 31 December 2024.
TERMS AND CONDITIONS
BCN Montjuic Tourist Point is the trading name of Limebuns Travel and Tours, a fully licensed and bonded travel agency and tour operator. Our registered office address is at Carrer d'Elkano, 41 Local 1 - 08004 Barcelona, Spain, with Spanish Tax Number of 26567760T. Our travel agency’s license number is GC-005034 duly issued by the Regional Government of Catalunya.
Application of Terms and Conditions
The mentioned terms and conditions below are solely imposed according to the standards of BCN Montjuic Tourist Point to ensure clarity and guidance of services. These terms and conditions may also cover all other communications agreed by both parties during the negotiation process. The BCN Montjuic Tourist Point serves the right to modify the terms and conditions with or without your consent.
A Contract of Agreement will be issued to the Client which explains all the information about the confirmed reservation. A reservation is considered confirmed once a required guarantee deposit or advance payments are completed. The paid transaction or all sorts of availing services are issued with a Confirmation Invoice. We highly recommend reviewing and acknowledging the Contract of Agreement together with the Invoice or Invoices prior to the agreed deadline to avoid any disappointment.
Governing Law
The Contract of Agreement and Invoices are fully governed by Spanish practices and any disputes hereafter will be resolved over the applied rules and laws of this country.
Definition of Terms
BCN Montjuic Tourist Point (BCN MTP) - is the trade name of Limebuns Travel and Tours, and/or its subsidiaries and/or its associated companies, and/or its authorized agents appointed in writing by BCN Montjuic Tourist Point.
We, Our, Us - refers to BCN Montjuic Tourist Point.
Client - any individual(s) who seeks assistance and/or contract from BCN MTP to provide travel and other services.
You, your, etc., - are references to the client and/or authorized representatives of the client
Services - refers to BCN Montjuic Tourist Point assistance regarding, but not limited to the following: recommendations, booking and/or arrangement, negotiation, and coordination of services via Third Party Suppliers to the Client.
Travel Services - refers to travel by air, land or sea, tour, accommodation, car rental, travel insurance, and other related services.
Supplier - any person, firm, or company with whom BCN MTP contracts for the provision of services or with whom BCN MTP contracts as agent for a Third Party Suppliers.
Third-Party Suppliers - any commercial or service provider with direct contact to the BCN MTP or direct to the client.
Reservation
The process of the booking will begin after a guaranteed deposit or advance payment is duly received. An Invoice Contract from BCN Montjuic Tourist Point is issued to the Client after your booking request has been processed and will be sent through official email communication or other electronic devices to solely approve the booking details, but may not be considered completely confirmed. All of the above are explained during the negotiation process.
Confirmation of Invoice
We aim to offer the best services and provide a high-quality experience all throughout the process together with your full cooperation. It is highly recommended to carefully review every detail of communication; especially the terms and conditions shared in all communications by BCN Montjuic Tourist Point in advance. Any last-minute changes, modifications, corrections, additional or any similar requests from the client without prior notice may not be guaranteed or accommodated.
Mode of Payment
These are the secured available options to process an advance payment or deposit not unless specific channels are agreed upon in advance. All transactions are only accepted in EURO currency. Please note that additional costs may be imposed depending on the clients’ bank miscellaneous fees, website administration fees, and variable conversion rates.
1. Wire transfer to our company bank account, details are mentioned on the invoice copy.
2. Digital payment through REDSYS or PAYPAL.
3. Credit card through email or telephone communication.
Price Policy, Payment Terms, and Surcharges
Prices published in all our marketing communications are quoted as pro-rated (proportional distribution), and BCN Montjuic Tourist Point has the full right to make changes. For instance, rates are adjusted prior to your confirmation and will be consulted to you during the negotiation process, or whenever required within the allowance period of at least 45 days prior to the commencement of the availing services.
Deposit and Final Balance
BCN Montjuic Tourist Point only considers each request as confirmed after a guarantee deposit of at least 40% of the total quoted amount is secured. The full settlement must be paid 45 days prior to the commencement of the availing services.
Late Payments
In an instance that a deposit is not completed upon the agreed date, all offers and negotiations are considered null, and should the client prefer to proceed beyond the cut-off period, BCN Montjuic Tourist Point will provide the closest best available options and different rates may also apply as this will be considered as a new request.
Additionally, the following conditions will also apply:
1. Suspension of all or part of the pre-selected services.
2. Imposed a penalty overdue by accumulating at least 2% of the total amount per month until payment is completed.
3. Cancel all availing services and deposits are fully forfeited. All fees and penalties incurred for late charges, penalties, or cancellations are directed to the client’s account.
Changes and Cancellation by BCN MTP
All confirmed services will proceed as scheduled not unless any unforeseen circumstances beyond our control will occur which may risk the safety of our clients. Our client's safety is our first priority at all times and BCN Montjuic Tourist Point will offer the best suitable alternative activities or solutions in such an event.
Changes and Cancellation made by the client
Changes beyond the final confirmation of the availing services cannot be guaranteed or accommodated. Date and space availabilities are limited closer to the commencement of services. All details and clarifications are discussed during the negotiation process or 45 days prior to the starting date. In an instance where changes and modifications are accepted, a price or penalty may be applied. Cancellations due to medical reasons are covered by your travel insurance, which is strongly recommended.
Cancellation of confirmed services must be requested by sending an official email to BCN Montjuic Tourist Point.
The following fees will apply:

45 days prior to starting date - 35% of the total full amount.

31 days prior to starting date - 65% of the total full amount.

30 days up to the actual day of confirmed booking - 100% payment or deposit is forfeited.
Refunds
Credits or refunds (if any) for Products or Services not used may only be issued upon the return of all the relevant documentation relating to the Travel Arrangements or Services concerned and are subject to the terms and conditions of the relevant Third Party Supplier.
In the event that any cancellation or refund requires the consent of or calculation by the relevant Third Party Supplier, then the invoice issued shall remain payable to BCN MTP, and any sum refunded by the Third Party Supplier shall only be credited to the client's account on receipt of the same by us from the Third Party Supplier.
All relevant documents required for a refund must be sent to BCN Montjuic Tourist Point by registered mail. It is the responsibility of the client to ensure that the documents are received by us.
Not all tickets or Travel services may be refunded or altered, and any refunds made may incur additional fees, which BCN Montjuic Tourist Point and/or the Third Party Supplier may, from time to time, levy. If the client is unsure as to the cancellation and/or refund provisions of any particular ticket, travel services, or the charges levied, then clarification should be sought at the time of booking.
There will be no refunds for any unused portion of the services according to the above-explained payment or deposit conditions, cancellations, and modifications.
Liabilities and Limitations
Please note that after the finalization of each booking and confirmation invoice was already sent to the Client(s), and there is an increase on the following but not limited to the following: entrance fees of monuments/museums, taxes, fuel cost, tour guide charges, or increase in the prices of the services of our third-party suppliers, likewise extra charges will be imposed.
BCN Montjuic Tourist Point acts only in the capacity of agent coordinator for the hotels, airlines, transporters, railways, and other commercialized service providers. Hence, all exchange orders, receipts, contracts, and tickets issued by us are subject to the terms & conditions under which these services are provided by them.
Numerous factors such as weather, road conditions, the physical ability of the participants, etc., may dictate itinerary changes either before the tour or during an ongoing service. We reserve the right to change any schedule in the interest of the trip participants' safety, comfort, and general well-being.
Our rates are based on the prevailing rates as negotiated by BCN Montjuic Tourist Point with the hotels, airlines, etc. Hotels and Airlines remain the right to modify the rates without notice. In the case of such changes, the rates quoted before the modification can be changed by us according to the modifications made by hotels or airlines. All hotel bookings are based on usual check-in and check-out time until unless indicated in the itinerary.
BCN Montjuic Tourist Point will not be responsible for any delays and alterations in the programme or expenses incurred – directly or indirectly – due to natural hazards, flight cancellations, accidents, breakdowns of machinery or equipment, breakdown of transport, weather, sickness, landslides, political closures, or any untoward incidents.
Flights or other travel arrangements to and from the destination of any services are not included in the costs payable to the company and it is your responsibility to arrange flights (if accurate) separately with a flight agent, airline, or supplier of your choice. In case of an error regarding flights or travel arrangements, we reserve the right not to be held responsible. You are required to inform us about your travel arrangements (e.g. flight number, terminal, exact time) at least thirty (30) days prior to arrival. Where we have agreed on supply transfers or "meet and greet services" we will attempt to accommodate any late changes. However, BCN MTP cannot guarantee that accommodation can always happen and we will not be held responsible for any losses or additional costs that may incur as a result of late changes and/or delays.
BCN Montjuic Tourist Point will not be responsible for any loss, injury, or damage to person, property, or otherwise in connection with any accommodation, transportation, or other services, resulting – directly or indirectly – from any act of GOD, danger, fire, accident, breakdown in machinery or equipment, breakdown of transport, wars, civil disturbances, strikes, riots, thefts, pilferages, epidemics, medical or custom department regulations, defaults, or any other causes beyond our control.
BCN MTP will not be responsible for the insurance policy covering the expenses for accident, sickness, loss due to theft, or any other reasons. Visitors are advised to seek such insurance arrangements in their home country. All items of baggage & personal properties at all times are at the client's responsibility.
Documentation
It is your responsibility to ensure that all requirements are met. These documents include passport, visa, travel insurance, health certificate, and other pertinent documents for your travel. Furthermore, BCN Montjuic Tourist Point reserves the right not to accept any responsibility for any refusal of travel, entry into any destination, or for any liabilities, losses, delays, or expenses incurred through any irregularity in such documents.
BCN Montjuic Tourist Point ensures that you will be given the right advice regarding the preparation of these documents and is given in good faith. However, it is your responsibility to make sure your documents are fully prepared, and you made your own research about other documents that you might need for your trip.
Waiver
No delay or failure to take action under these Terms and Conditions shall constitute any waiver by us of any provision of these Terms and Conditions.
Variation
BCN MTP reserves the right to review and adjust all elements of fees without prior notice to take account of (but not limited to) inflation, increased charges, costs, or changes to terms and conditions by Third Party Suppliers or other parties that may affect us.
Behavior
The BCN MTP expects its clients/tourists to show their best behavior at all times. This is not only for general decency but also for the welfare, safety, and security of other travelers as well. Furthermore, our clients are expected to comply and obey the laws, customs, and traditions of the travel destination as well as treating the locals with respect and obey any instructions, rules, and regulations advised by BCN MTP and/or the organizers of any services. In case those mentioned above are not followed and problems occur (including loss of business or reputation), you will be personally liable to BCN MTP. In case these problems arise, BCN MTP reserves the right to cancel all outstanding services, without refund.
Complaint
If you have a complaint(s) with any of our services, you have to bring this to our attention immediately. We will then try to rectify the situation. If your complaint is not resolved during the service, you have the opportunity to bring this to our attention within two(2) weeks after your return, giving all the relevant pieces of information. If you fail to follow this procedure, we will not be able to process your complaint.
Publicity and Use of Images
We reserve the right to take photographs or films during the services provided by BCN MTP. Photos and videos will be used for our literature, brochures, and on our website. If you do not agree, please inform us prior to your arrival.
Security
Reasonable steps have been put in place for security measures to protect any data which is provided by the client in relation to the Travel Services. The server hosting our website uses SSL (secure sockets layer) data encryption to help keep your data secure. Where possible, personal information entered is encoded before it is sent to us, protecting it as it is transferred over the Internet. However, the client accepts that the transmission of information via the internet is not completely secure and while BCN Montjuic Tourist Point will make commercially reasonable efforts to ensure that any information entered into our website is secured, it does not guarantee the security of the data transmitted to or from these services.
Data Protection
a) In providing Travel Services to the client, we may collect and process personal data (including names, contact details, passport numbers, credit card details, travel preferences, and dietary requirements) relating to the client and/or the person for whom the client is making travel arrangements in order to make bookings for Travel Services with Third Party Suppliers.
b) The Client acknowledges that in order to make a booking with Third Party Suppliers, we may transfer and store personal data both inside and outside the European Economic Area, and the client (s) allows BCM MTP to transfer and store personal data in this way.
c) A copy of the personal data of our client and any passengers for whom the client is making travel arrangements can be requested by the client or the Passenger(if applicable) at any time.
d) The Client acknowledges that we may transfer the client’s data (including personal data) to Third Party Suppliers and that any use of such data by the Third Party Suppliers will be in accordance with their terms and conditions.
Confidentiality
a) Each party undertakes to the other to keep all information confidential (written, oral, or in electronic form) concerning the business, business systems, methodologies, and affairs of the other that it shall have obtained or received as a result of the provision of Arrangement Services or Travel Services (“Confidential Information”).
b) Notwithstanding the above, the parties may disclose Confidential Information to:
i.) their parent company or subsidiary and their officers, directors, employees, and professional advisers (including auditors);
ii.) where requested or required by any court of competent jurisdiction or any competent judicial, governmental, supervisory, or regulatory body or;
iii.) with the prior written consent of the other party.
c) For the avoidance of doubt, Confidential Information excludes information that:
i.) is or becomes public knowledge other than as a direct or indirect result of any breach of this clause 15 or;
ii.) is known by a party before the date the information is disclosed by the other party or is lawfully obtained by a party after that date.
